Robert F. Kennedy Jr. is suing the North Carolina State Board of Elections in a final bid to remove his name from the state’s ballot for the 2024 presidential election.

According to WCCB, the lawsuit, filed Friday in Wake County Superior Court, argues that the board’s refusal to honor his request violated both state election law and his free speech rights. Kennedy, who suspended his campaign and endorsed Donald Trump in August, is seeking to withdraw his candidacy in battleground states like North Carolina while aiming to stay on the ballot in less competitive areas such as New York.

If the court does not rule in his favor, Kennedy’s name will appear on the North Carolina ballot in November.
